The victim was then forced onto the bed by Peter who hurt him by pressing down on the base of his neck without his permission. The victim was having trouble breathing and was beginning to lose consciousness but he did not respond because he was afraid of him and worried that if he did, he might do even worse things. The coworker of the victim recorded the conversation on his cell phone. Peter is seen on video grabbing the victim by the throat as the bed sinks and Schmidt later told police that he grabbed the victim by the neck but did not choke him.
He was detained in each instance and he was later charged with strangulation and suffocation (a felony) and disorderly conduct (a misdemeanor). He was in the end condemned to two years probation expected to take outrage the executives classes go through a mental evaluation and was requested to compose a letter of expression of remorse to the person in question.
When Peter Schmidt ran for the Wisconsin State House everything was made public.
