The coworker of the victim recorded the conversation on his cell phone. Peter is seen on video grabbing the victim by the throat as the bed sinks and Schmidt later told police that he grabbed the victim by the neck but did not choke him.

He was detained in each instance and he was later charged with strangulation and suffocation (a felony) and disorderly conduct (a misdemeanor).
